"Radio personality Shannon Burke must serve another jail term— this one for 60 days — for violating his probation in Orange County, a judge ruled this afternoon.
County Judge Faye Allen ordered that Burke begin this new sentence after completing his six-month stay in Seminole County jail in the shooting of his wife and her dog in their bedroom April. He was drinking alcohol, and said it was an accident.
When the shooting took place, Burke was on probation for a July 2007 alcohol-related reckless-driving incident in Orange County. He pleaded no contest and was sentenced Nov. 2008 to 364 days probation.
Burke pleaded guilty to felony animal cruelty and opening fire in a building in November, and guilty to a probation violation in December.
During today's 2 p.m. hearing, attorney Mark O'Mara argued by telephone that his client should serve his violation of probation sentence while he sat in jail for the shooting case. Under this scenario, he would serve no additional time.
Wife Catherine Burke, who was grazed in the head during the shooting, was in the courtroom. She and her dog have since recovered.
O'Mara said the former talk-show host changed his life immediately after the shooting, which took place while he was intoxicated. He has undergone counseling, and served in the Seminole jail ministry.
"He is not the Shannon Burke that caused that event to happen," O'Mara said.
Assistant State Attorney Crystal Segui argued Burke be sentenced to 90 days in jail, the maximum penalty. Burke was drinking alcohol before the shooting, which showed he did not take probation seriously, she said.
Plus, one month before the shooting, Burke convinced an evaluator involved in his probation that he did not need substance-abuse treatment, Segui told Allen.
"I submit to you this individual is very good at convincing people he doesn't need any help," the prosecutor said. Segui added that Burke could continue substance addiction treatment in jail.
Allen commended Burke on his volunteer work before and after the shooting, but said she was troubled that he committed such a serious offense after her lenience in the 2007 case.
"There seems to be a constant theme of denial in your case," Allen told Burke.
Allen also adjucated Burke guilty for the underlying offense of reckless driving and gave him credit for 10 days he already spent in jail.
Burke turned himself in Dec. 31 to begin his sentence in the shooting case.
